USA - EPA Adopted the Reporting and Recordkeeping Requirements for PFAS
The US Environmental Protection Agency (EPA) is amending the Toxic Substances Control Act (TSCA) reporting and recordkeeping rule for per- and polyfluoroalkyl substances (the Rule) to delay the reporting deadline by eight months. The Rule, as finalised last year, included a reporting window that would open on 12 November 2024 and close for most companies on 8 May 2025. EPA is now delaying the reporting window by eight months. With this delay, the reporting window will open on 11 July 2025 and close for most companies on 11 January 2026.
In accordance with obligations under TSCA, as amended by the National Defense Authorization Act for Fiscal Year 2020, EPA is requiring persons that manufacture (including import) or have manufactured these chemical substances in any year since January 1, 2011, to submit the following information regarding PFAS to EPA:
- uses
- production volumes
- byproducts
- disposal
- exposures
- existing information on environmental or health effect
The following persons, including but not limited to, may have the obligations to report the PFAS information to EPA:
- Construction
- Manufacturing
- Wholesale trade
- Retail trade
- Waste management and remediation services
In addition to fulfilling statutory obligations under TSCA, this rule will enable EPA to better characterize the sources and quantities of manufactured PFAS in the US.
The final rule is effective on November 13, 2023.
