USA - New York Proposed to Phase Out Products Containing PFAS

​New York introduced a bill (AB 9005) on February 1, regarding the phase-out of products containing per- and polyfluoroalkyl substances (PFAS).


The following products cannot be distributed, sold, or offered for sale if containing any intentionally added PFAS from January 1, 2027:
- carpet or rug
- cookware
- cosmetic product
- fabric treatment
- personal care product


All products containing intentionally added PFAS would be prohibited from January 1, 2032.


Furthermore, the bill also proposed a reporting requirement for product containing intentionally added PFAS. A manufacturer of a product that contains intentionally added PFAS shall submit a written notification to the department from January 1, 2026:
- a brief description of the product
- the purpose for which PFAS are used in the product, including any product components
- the amount of each of the PFAS
- the name and address of the manufacturer, and the name, address and phone number of a contact person for the manufacturer
- any additional information established by the Department
