USA - Minnesota Adopted the PFAS Prohibition and Reporting Requirements for a Wide Variety of Consumer Products

​Minnesota's governor signed the bill (HF 2310A) into law on May 24, adopting ​the PFAS prohibition and reporting requirements on a wide variety of consumer products.

The following products are not allowed in the State from January 1, 2025 if they contains intentionally added PFAS:

- carpets or rugs
- cleaning products
- cookware
- cosmetics
- dental floss
- fabric treatments
- juvenile products (intended for 12 years of age or below)
- menstruation products
- textile furnishings
- ski wax or
- upholstered furniture

And a total ban of PFAS in the State will be from January 1, 2032 which means any products containing intentionally added PFAS is not allowed in Minnesota. However, if the commissioner of the Pollution Control Agency has determined by rule that the use of PFAS in the products is a currently unavoidable use, then the use of it would be exempted from this total ban.

Moreover, from January 1, 2026, the following information must be submitted to the commissioner if product sold, offered for sale, or distributed in Minnesota that contains intentionally added PFAS otherwise the product cannot be sold in the State:

- a brief description of the product, including a universal product code (UPC), stock keeping unit (SKU), or other numeric code assigned to the product
- the purpose for which PFAS are used in the product
- the amount of each PFAS
- the name and address of the manufacturer and the name, address, and phone number of a contact person for the manufacturer
- any additional information requested by the commissioner​
