Philippines - Draft New Rules for Toys and Childcare Articles for Comment
The Center for Cosmetics and Household/Urban Hazardous Substances Regulation and Research (CCHUHSRR) is hereby circulating the draft of the attached proposed administrative order, provisionally entitled “Rules and Regulations Governing the Issuance of Authorizations for Toys and Childcare Articles (TCCA)” for comments. The public consultation is open until January 15.
The proposed issuance aims to:
1. Update and align the TCCA regulations with appropriate laws, locally-established standards, and internationally-accepted standards;
Toys
i. PNS/BHDT ISO 8124-1:2008 – Safety of toys – Part 1: Safety aspects related to
mechanical and physical properties or their accepted equivalent
ii. PNS/BHDT ISO 8124-2:2008 – Safety of toys – Part 2: Flammability or its accepted
equivalent
iii. PNS/BHDT ISO 8124-3:2008 – Safety of toys – Part 3: Migration of certain
elements or their accepted equivalent
iv. PNS/BHDT ISO 8124-4:2012 – Safety of toys – Part 4: Swings slides and similar
activity toys for indoor and outdoor family domestic use or its accepted equivalent
v. PNS ISO 8124-7:2022 – Safety of toys – Part 7: Requirements and test methods for
finger paints
vi. PNS ISO 8124-10:2022 – Safety of toys – Part 10: Experimental sets for chemistry
and related activities
vii. PNS ISO 8124-11:2022 – Safety of toys – Part 11: Chemical toys (sets) other than experimental sets
Childcare articles, including baby feeding set, bottle teats / Nipples, feeding bottles, pacifiers / soothers, sippy cups, teething aids, toothbrushes for babies, etc
i. PNS/BHDT ISO 8124-3:2008 – Safety of toys – Part 3: Migration of certain elements or their accepted equivalent
TCCA products must be free from substances banned by the DOH and the FDA and/or
30 must not contain ingredients restricted by the DOH and the FDA in concentrations
31 exceeding allowable limits.
- Phthalates must not be exceeding the limit of 0.1%:
i. di-(2-ethylhexyl)phthalate (DEHP)
ii. dibutyl phthalate (DBP)
iii. benzyl butyl phthalate (BBP)
iv. diisobutyl phthalate (DIBP)
v. diisononyl phthalate (DINP)*
vi. diisodecyl phthalate (DIDP)*
vii. di-n-octyl phthalate (DNOP)*
*Limit applies only for TCCA that can be placed in the mouth
- Childcare articles, particularly infant feeding bottles and sippy cups, shall not contain Bisphenol A (BPA).
- An updated list of banned substances shall be kept, maintained and published through
49 the appropriate FDA issuances
2. Institutionalize the Product Notification procedure for toys and childcare articles;
3. Rationalize the issuance of Certificates of Exemption for exempted toys, games, and childcare articles; and,
4. Provide the roles and responsibilities of marketing authorization holders in ensuring the safety, efficacy, and quality of toys and childcare articles throughout the product life cycle.
In view of the foregoing, all concerned stakeholders, including TCCA Manufacturers, Distributors, Traders and other related establishments are requested to submit any comments on the proposed issuance.
