EU - New Version EN 71-13:2021
On April 21, 2021, the European Committee for Standardization CEN published EN 71-13:2021 as a new version of the standard “Safety of toys - Part 13: Olfactory board games, cosmetic kits and gustative games". This standard supersedes the current version EN 71-13:2014.
Changes compared to the previous version
Olfactory board games (Clause 4.1.2.3)
- Articles for children below 36 months shall not contain any of the 26 fragrances listed in Table 1.
Gustative Games (Clause 4.3.1)
- The instructions for use may suggest the use of food ingredients (e.g. drinking water, salt, sugar or honey).
- Gustative Games shall be supplied with an ingredient list visible from outside the packaging.
Cosmetic Kits (Clause 4.2.1)
- Cosmetic kits (as multi-component cosmetic products) and its individual components are considered as cosmetic products and thus fall under the scope of REGULATION (EC) No 1223/2009 on cosmetic products. This applies to both composition and labeling.
- The instructions for use may suggest the use of denatured alcohol (ethanol) as well as substances or mixtures that are not classified as hazardous mixtures (e.g. drinking water, salt, sugar or honey).
- Cosmetic kits shall be supplied with an ingredient list visible from outside the packaging.
Containers (Clause 5.2.3)
- Child-resistant containers shall comply with EN ISO 8317:2015. The previous options
a) EN ISO 8317; b) Closure test A according to Annex C.1 as well as c) Closure test B according to Annex C.2 have been deleted.
General markings and warnings (Clause 6.1):
- Gustative games and cosmetic kits: In the age-related warning "Not suitable for children under (*) years." the age shall be 3 years or older.
- Articles containing one or more of the allergenic fragrances listed in Table 1 must additionally carry the age-related warning "Not suitable for children under 36 months.".
Timeline for implementation
EN 71-13:2021shall be given the status of a national standard at the latest by October 31, 2021; conflicting national standards shall be withdrawn at the latest by April 2022.
Germany has published DIN EN 71-13:2021-06 in June 2021. This document replaces DIN EN 71-13:2014-07.
Harmonization (citation in the EU Official Journal as the basis for presumption of conformity with Directive 2009/48/EC on the safety of toys) is assumed to take place with the next edition, which is expected in August 2021. At the end of the transitional period for harmonization (probably in 3-6 months), the standard will be mandatory.
