EU - Amendments on Annex XVII to REACH Regulation

​There are several amendments on Annex XVII to REACH Regulation regarding carcinogenic, mutagenic or reproductive toxicant (CMR) substances, devices covered by Regulation (EU) 2017/745 Persistent Organic Pollutants, certain liquid substances or mixtures, nonylphenol and testing methods for azocolorants and the details are as follows:

Entry 3, Column 2
Paragraph 3, 5, 6 & 7

3. Shall not be placed on the market if they contain a coloring agent, unless required for fiscal reasons, or perfume, or both if they:
- can be used as fuel in decorative oil lamps for supply to the general public, and
- present an aspiration hazard and are labeled with R65 or H304,

5. Without prejudice to the implementation of other Community Union​ provisions relating to the classification, packaging labeling and labeling packaging of dangerous substances and mixtures, suppliers shall ensure, before the placing on the market that the following requirements are met:

(a) lamp oils, labeled with R65 or H304, intended for supply to the general public are visibly, legibly and indelibly marked as follows: ‘Keep lamps filled with this liquid out of the reach of children’; and, by December 1, 2010, ‘Just a sip of lamp oil — or even sucking the wick of lamps — may lead to life-threatening lung damage’;

(b) grill lighter fluids, labelled with R65 or H304, intended for supply to the general public are legibly and indelibly marked by December 1, 2010 as follows: ‘Just a sip of grill lighter may lead to life threatening lung damage’;

(c) lamp oils and grill lighters, labelled with R65 or H304, intended for supply to the general public are packaged in black opaque containers not exceeding 1 litre by December 1, 2010.​

Paragraph 6 & 7 are deleted.

Entry 22 regarding pentachlorophenol
Deleted as more severe restriction is laid down for the substance in the Regulation (EU) 2019/1021 - POP Regulation recast

Entry 46, column 1
Deleted the CAS & EC numbers in paragraph (a) (CAS 25154-52-3 & EC 246-672-0)

Entries 67 regarding bis(pentabromophenyl)ether (decabromodiphenyl ether, decaBDE)
Deleted as more severe restriction is laid down for the substance in the Regulation (EU) 2019/1021 - POP Regulation recast

Entries 68 regarding perfluorooctanoic acid (PFOA)
Deleted as more severe restriction is laid down for the substance in the Regulation (EU) 2019/1021 - POP Regulation recast​ and effective on July 4, 2020​​

​Appendix 10

Updated the testing methods for azocolorants for the purposes of entry 43 as several of the listed testing methods are outdated and have been replaced by the European Committee for Standardization with more up-to-date testing methods.

1. EN ISO 17234-1:2010 changed to EN ISO 17234-1:2015
2. EN 14362-1:2012 changed to EN ISO 14362-1:2017
3. EN 14362-3:2012 changed to EN ISO 14362-3:2017

And some other minor amendments, e.g. changing titles and inserting new entries in tables of various appendixes. More information can be found in the original source.
